BARKERA STEM KIT
TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the purchase, registration, access, participation in, receipt, use, and interaction with the Barkera Veterinary STEM Kit and all related educational materials, curriculum, online content, digital resources, websites, applications, assessments, activities, programs, events, communications, and services (collectively, the “Program”).
The Program is owned and operated by Barkera Corp. (“Barkera,” “Company,” “we,” “our,” or “us”).
By purchasing, receiving, registering for, accessing, participating in, or using the Program, you agree to be legally bound by these Terms.
If you are a parent, legal guardian, educator, school, organization, or purchaser acting on behalf of a participant, you agree to these Terms on behalf of yourself and the participant.

1. Eligibility and Participation
The Program is intended for educational use by students, families, educators, schools, youth organizations, camps, and authorized participants.
Participants under eighteen (18) years of age must have the permission and supervision of a parent, legal guardian, educator, or authorized adult.
Participants under thirteen (13) years of age may only participate with verifiable parental consent where required by applicable law, including the Children’s Online Privacy Protection Act (“COPPA”).
By participating in the Program, you represent and warrant that:
• You meet all eligibility requirements;
• You have authority to enter into these Terms;
• Information provided to Barkera is accurate and current;
• You will comply with all Program instructions, policies, and safety requirements.

2. Parental Responsibility
Parents and guardians are solely responsible for:
• Determining whether the Program is appropriate for their child;
• Reviewing Program materials;
• Supervising participation when appropriate;
• Monitoring online activity;
• Evaluating allergies, sensitivities, disabilities, developmental considerations, and medical conditions;
• Ensuring compliance with all safety instructions.
Barkera does not supervise children participating in the Program.

3. Educational Purpose Disclaimer
The Program is provided solely for educational, informational, enrichment, and career-awareness purposes.
The Program does not provide:
• Veterinary advice;
• Medical advice;
• Diagnosis or treatment recommendations;
• Professional veterinary services;
• Veterinary certification;
• Educational accreditation;
• Professional licensure;
• Career placement services.
Participation does not create a veterinarian-client-patient relationship, educational accreditation, professional certification, employment relationship, or professional qualification of any kind.
Information regarding veterinary medicine, biology, anatomy, animal care, nutrition, health, or related topics is provided solely for educational purposes.
Participants should always consult qualified professionals regarding actual veterinary, medical, educational, or professional matters.

4. Adult Supervision Requirements
Certain Program activities may involve tools, materials, equipment, liquids, powders, models, demonstrations, or experiments.
Parents, guardians, teachers, and supervising adults are solely responsible for determining the appropriate level of supervision for each participant.
Any age recommendations or supervision guidelines provided by Barkera are advisory only.

5. Product Safety and Assumption of Risk
The Veterinary STEM Kit is not a toy and is intended as an educational product.
The Program may include physical materials, educational supplies, scientific models, laboratory-style activities, demonstrations, simulations, experiments, and related components.
Participation involves inherent risks, including but not limited to:
• Minor cuts or scrapes;
• Allergic reactions;
• Material sensitivities;
• Property damage;
• Misuse of materials;
• Accidental injury;
• Choking hazards associated with small parts.
Participants, parents, and guardians voluntarily assume all risks associated with participation.
Participants agree to follow all instructions, warnings, safety notices, and recommended age guidelines.

6. Choking Hazard and Small Parts Notice
Certain Program components may contain small parts and materials that may present choking hazards.
Program materials should be kept away from children below the recommended age range unless directly supervised by a responsible adult.
Parents and guardians are solely responsible for determining whether Program materials are appropriate for their child.

7. Allergies and Medical Conditions
Barkera does not guarantee that Program materials are free from allergens, irritants, or substances that may cause adverse reactions.
Parents and guardians are responsible for evaluating Program suitability based upon the participant’s health, allergies, sensitivities, disabilities, or medical conditions.

8. Orders, Shipping, and Delivery
Barkera may offer Program materials for purchase, shipment, subscription, or distribution.
Delivery dates are estimates only.
Barkera is not responsible for delays caused by:
• Shipping carriers;
• Weather conditions;
• Supply chain disruptions;
• Customs delays;
• Labor shortages;
• Events beyond our reasonable control.
Participants are responsible for providing accurate shipping information.

9. Returns, Refunds, and Replacements
Returns, replacements, refunds, exchanges, and damaged product claims shall be governed by Barkera’s published policies in effect at the time of purchase.
Barkera reserves the right to investigate claims relating to damaged, defective, incomplete, lost, or incorrect shipments prior to issuing replacements or refunds.

10. Curriculum and Component Changes
Barkera may modify, enhance, substitute, discontinue, replace, or update Program materials, curriculum, activities, assessments, educational content, technologies, supplies, or STEM Kit components at any time without prior notice.
Equivalent substitutions may be provided when necessary.

11. User Conduct
Participants may not:
• Violate applicable laws;
• Engage in abusive, threatening, discriminatory, or harmful conduct;
• Share inappropriate content;
• Misrepresent identity or age;
• Attempt unauthorized access to systems;
• Interfere with Program operations;
• Use the Program for unauthorized commercial purposes.
Barkera may suspend or terminate participation for violations of these Terms.

12. Intellectual Property Rights
The Program contains valuable proprietary information and intellectual property owned by Barkera and its licensors.
Protected materials include:
• Curriculum;
• Lesson plans;
• Educational methodologies;
• Assessments;
• Scoring systems;
• Veterinary simulations;
• Worksheets;
• Activities;
• Videos;
• Graphics;
• Logos;
• Trademarks;
• Software;
• Educational frameworks;
• Research materials;
• Content strategies and educational models.
No ownership rights are transferred to participants.
Except as expressly authorized in writing, Program materials may not be copied, reproduced, modified, distributed, published, sold, licensed, reverse engineered, or otherwise exploited.

13. User Content, Submissions, and Media
Participants, parents, guardians, schools, educators, and organizations may submit projects, assignments, photographs, videos, artwork, survey responses, testimonials, comments, competition entries, or other materials (“Submissions”).
By submitting any Submission, the submitting party grants Barkera a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to use, reproduce, publish, display, distribute, modify, adapt, analyze, archive, and create derivative works from such Submissions for educational, operational, research, scientific, artificial intelligence, community, promotional, marketing, public relations, and business purposes.
Nothing obligates Barkera to publish or use any Submission.
Separate media releases may be required for identifiable photographs, videos, recordings, or promotional materials involving minors.

14. Research, Analytics, Artificial Intelligence, and Educational Data
Barkera operates educational, scientific, research, benchmarking, analytics, artificial intelligence, and industry advancement initiatives.
Subject to applicable law and Barkera’s Privacy Policy, Barkera may collect, process, analyze, maintain, and utilize information relating to Program participation, educational engagement, surveys, assessments, curriculum interactions, performance metrics, and related Program information.
Barkera may create anonymized, aggregated, statistical, benchmark, trend, derivative, predictive, analytical, research, educational, scientific, and artificial intelligence datasets and outputs.
Such anonymized and derivative information shall be exclusively owned by Barkera and may be used for educational initiatives, publications, curriculum development, industry reports, benchmarking programs, artificial intelligence systems, scientific research, and related lawful purposes.

15. Children’s Privacy
Barkera is committed to protecting children’s privacy.
Where applicable, Barkera will comply with COPPA and other applicable privacy laws.

16. Disclaimer of Warranties
THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKERA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, EDUCATIONAL EFFECTIVENESS, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY.
BARKERA DOES NOT GUARANTEE ANY PARTICULAR EDUCATIONAL, ACADEMIC, CAREER, PROFESSIONAL, OR LEARNING OUTCOME.

17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
BARKERA’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PROGRAM SHALL NOT EXCEED THE GREATER OF:
(A) THE TOTAL AMOUNT PAID FOR THE APPLICABLE PROGRAM OR STEM KIT; OR
(B) TWO HUNDRED FIFTY U.S. DOLLARS ($250.00).

18. Indemnification
Participants, parents, guardians, purchasers, schools, educators, and organizations agree to defend, indemnify, and hold harmless Barkera and its officers, directors, employees, contractors, affiliates, licensors, successors, and assigns from claims arising out of:
• Participation in the Program;
• Violation of these Terms;
• Misuse of Program materials;
• Violation of law;
• Negligent or wrongful conduct.

19. Suspension and Termination
Barkera may suspend, restrict, or terminate access to the Program at any time for:
• Safety concerns;
• Violations of these Terms;
• Fraudulent activity;
• Misconduct;
• Non-payment;
• Legal compliance requirements.
Termination shall not affect previously accrued rights or obligations.

20. Force Majeure
Barkera shall not be liable for delays, interruptions, or failures resulting from causes beyond its reasonable control, including acts of God, weather events, pandemics, governmental actions, labor disputes, transportation interruptions, supplier shortages, utility outages, or technology failures.

21. School, Classroom, and Educational Organization Licensing
All Program materials are licensed and not sold.
Purchase of a STEM Kit or Program grants only a limited, non-exclusive, non-transferable license for authorized participant use or authorized classroom use.
Schools, educators, districts, camps, educational organizations, and institutions may not reproduce, distribute, upload, publish, commercialize, sublicense, or create derivative works from Program materials except as expressly authorized by Barkera.
District-wide, organizational, enterprise, and multi-campus licensing may require separate written agreements.

22. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY.
To the fullest extent permitted by law, any dispute arising from or relating to the Program, these Terms, any STEM Kit, any purchase, or any relationship between the parties shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable consumer arbitration rules.
The arbitration shall occur in Broward County, Florida unless otherwise required by law.
The parties waive any right to a jury trial.
Nothing in this section prevents Barkera from seeking injunctive relief to protect intellectual property, confidential information, or proprietary rights.

23. Class Action Waiver
To the fullest extent permitted by law, all claims must be brought solely on an individual basis.
Participants, parents, guardians, schools, organizations, educators, and purchasers waive any right to participate in:
• Class actions;
• Collective actions;
• Representative actions;
• Mass arbitrations; or
• Consolidated proceedings.

24. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflict of law principles.
To the extent court proceedings are permitted under these Terms, exclusive jurisdiction and venue shall lie in Broward County, Florida.

25. Changes to Terms
Barkera may modify these Terms at any time.
Updated versions become effective upon posting.
Continued participation following publication of revised Terms constitutes acceptance of the updated Terms.

26. Electronic Acceptance
By purchasing, registering for, accessing, receiving, participating in, downloading, activating, opening, or otherwise using any Program, STEM Kit, website, educational content, portal, or related service, you acknowledge that you have read, understood, and agreed to these Terms.
Electronic acceptance shall have the same legal force and effect as a handwritten signature.
